BiAffect Mobile Application Privacy Notice

INTRODUCTION: BY INSTALLING, USING OR OTHERWISE ACCESSING THE BiAffect APPLICATION FROM ANY DEVICE, MOBILE OR OTHERWISE, YOU ARE AGREEING TO ABIDE BY THE TERMS AND CONDITIONS OF THIS PRIVACY NOTICE. IF YOU DO NOT AGREE TO THESE TERMS AND CONDITIONS, DO NOT DOWNLOAD AND/OR ACCESS OUR APPLICATION. BY USING THIS APPLICATION, YOU ARE CONSENTING TO THE COLLECTION, USE, AND DISCLOSURE OF INFORMATION IN ACCORDANCE WITH THIS PRIVACY NOTICE.

This Privacy Notice sets forth how your information is collected, used, transferred, and stored through the mobile application titled “BiAffect” (“Application”) and the terms and conditions governing your use of the Application. The Application was created by the University of Illinois Urbana-Champaign and is owned by the Board of Trustees of the University of Illinois (“University,” “we,” “our,” “us”).

This Privacy Notice is subject to the Application Terms of Service; the University of Illinois System Privacy Statement, which contains among other sections the Rules for Individuals under Thirteen Years of Age; the Legal Notice and Terms of Use, which contains among other provisions, disclaimers of: liability, warranties and accuracy of data, endorsement, external links, and duties regarding data; and the University of Illinois Supplemental Privacy Notice for certain persons in the European Economic Area and the United Kingdom (Supplemental Privacy Notice).

  1. What information may the Application collect?
    1. Personal Information. “Personal Information” for purposes of this Privacy Notice means information that can be used to identify, contact, or locate an individual, such as, your name and email address.

    The Application collects certain Personal Information, including name, email address, and other as contained in the IRB consent form. You are not required to provide the Personal Information requested by the Application; however, you will not be able to use Application if you choose not to provide your Personal Information including the IRB-approved consent.

    Periodically we will ask you to answer questions and perform some activities via your mobile phone. These survey questions may be about your health, exercise, diet, sleep, medicines, etc. or about how you are feeling in general. In addition to surveys, the activities will be some brief tasks that you perform while holding your phone for a short period of time. We will ask you to perform specific tasks weekly while holding or using your mobile phone and record sensor data directly from your phone. Your study data will include your responses to surveys and the measurements from the phone itself when you perform an activity.

    By providing us with your Personal Information, you are consenting to our use of it in accordance with this Privacy Notice, the University of Illinois System Privacy Statement, and the Supplemental Privacy Notice.

    Other information accessed on device: With your permission, we also access additional personal information on your device listed as follows: the Application will install a custom-built keyboard that replaces the standard default iPhone keyboard in order for the researchers to better understand keyboard dynamics metadata (but not to track the actual words). Your study data will include your responses to surveys and the measurements from the phone itself when you perform an activity.

  2. How Is Your Personal Information Used?

    User personal information is collected to provide a service or function that is directly relevant to the use of the Application. Specifically, the research team will analyze the combined data and report findings back to the community through blogs or scientific publications. Your data, without your name, will be added to the data of other study participants and may be analyzed by the study team. You will have a unique account that you can use to review your own data.

  3. Is Your Personal Information Shared With Any Third Parties Outside The University?

    We may share your Personal Information outside the University as required by law, order of governmental authority, or court order to be disclosed; when we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or respond to a government request. The University does not sell or lease your Personal Information to third parties.

  4. How Is Your Information Protected?

    We follow generally accepted industry standards to protect information processed by the Application. No method of transmission, or method of electronic storage, is 100% secure. Therefore, we cannot guarantee its absolute security.

  5. Where Will the Information Be Stored?

    All Personal Information and Non-Personal Information is stored in the Application.

    Your Personal Information and Non-Personal Information is also stored on a secure cloud-based server.

  6. Opt-In and Opt-Out Information

    You may change your information preferences and opt-out of information collection by uninstalling the Application. Your participation in this study is voluntary. If you are eligible and decide to participate, we will ask you to provide an e-signature, by signing with your finger on the screen at the end of the enrollment process. We will also send a copy of this consent form, along with your e-signature, to your email address.

    You do not have to sign this consent form. But if you do not, you will not be able to participate in this research study. You may decide not to participate or you may leave the study at any time. Your decision will not result in any penalty or loss of benefits to which you are entitled.

    Although you can withdraw from the study at any time, you cannot withdraw the coded study data that have already been distributed. If you withdraw from the study, we will stop collecting new data but the coded data that you have already provided will not be able to be destroyed or deleted.

    The Study Principal Investigator or the sponsor may also withdraw you from the study without your consent at any time for any reason, including if it is in your best interest, you do not consent to continue in the study after being told of changes in the research that may affect you, or if the study is cancelled.

  7. How Long Is Your Personal Information Stored?

    We will retain Your Personal Information for as long as you use the Application and for a reasonable time thereafter. If you would like us to delete your Personal Information that you have provided via the Application, please contact us at contact@biaffect.com and we will respond in a reasonable time. Please note that some or all the user Personal Information may be required for the Application to function properly, and we may be required to retain certain information by law.

  8. Changes to this Privacy Notice

    We may amend this Privacy Notice from time to time. If we amend this Privacy Notice, we will post the changes on BiAffect Privacy Notice - University of Illinois System (uillinois.edu). Your continued use of the Application after any such changes will constitute your acceptance of the updated Privacy Notice. If you do not wish to accept the revised Privacy Notice, you must not use or access (or continue to use or access) the Application. Please regularly check the Application or website to determine if the Privacy Notice has been updated and to review those changes before deciding whether to access (or continue to access) the Application.
